Lagos renting rights in 60 seconds
Checked 15 October 2026. LAW = in force today (Lagos State Tenancy Law 2011). BILL = proposed in the Tenancy and Recovery of Premises Bill 2025, which is not yet law.
- LAW A new tenant can't be asked for more than 1 year's rent in advance; a sitting monthly tenant not more than 6 months, a sitting yearly tenant not more than 1 year. Paying or receiving more is an offence for both sides: up to โฆ100,000 fine or 3 months' imprisonment (s.4).
- LAW The 2011 Law does not apply in Apapa, Ikeja GRA, Ikoyi and Victoria Island (s.1(3)).
- LAW Landlords must give a rent receipt showing the date, names and addresses, the premises, the amount and the period (s.5).
- LAW Forced eviction is an offence: forcibly ejecting a tenant, threatening them to make them leave, or altering the building to force them out without the court's approval carries up to โฆ250,000 or 6 months' imprisonment (s.44).
- LAW For service charges and deposits you get a separate receipt and a written account at least every 6 months (s.10).
- LAW Notice to quit when your agreement is silent: 1 week (tenant at will), 1 month (monthly), 3 months (quarterly or half-yearly), 6 months (yearly) (s.13(1)). After a fixed term ends, the landlord serves a 7-day notice of intention to recover possession (s.13(5)).
- BILL Would cover all of Lagos, cut advance rent for sitting monthly tenants to 3 months, raise the penalty to โฆ1,000,000 or 3 months, cap agent commission at 5% of a year's rent, require LASRERA registration, receipts and remitting money to the landlord within 7 working days, and allow a 7-day notice after 2 months' arrears on a monthly tenancy.
